SUMMARY & BACKGROUND:

The Division of Water Reclamation has multiple processes which separate detritus and debris from incoming sewage and collect it in roll off containers. On January 23, 2024 the one reliable roll off truck used to haul the containers caught fire and was destroyed. The one remaining unreliable truck is insufficient to service the plant. Water Reclamation negotiated with Jack Doheny Company for purchase of a used vehicle suitable for service.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the appropriation of $325,000 from the unappropriated balance of the Sewer Replacement Fund is authorized to Account Code 6073-36000-4UC2624STDSTD for emergency purchase of a roll off truck for use by the Bay View Water Reclamation Plant; and the expenditure of the same is authorized.

 

SECTION 2.                     That the Mayor is authorized to enter into a contract with Jack Doheny Company for emergency purchase of a used roll off truck for the Bay View Water Reclamation Plant, upon terms and conditions approved by the Director of Public Utilities and the Director of Law.

 

SECTION 3. That this Council finds and determines that it is in the best interest of the City that the competitive provisions of TMC Chapter 187 are waived for the reason that Jack Doheny Company was immediately ready to proceed with emergency procurement of a roll off truck at the Bay View Water Reclamation Plant.

 

SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $325,000 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.

 

SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

 

                     SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to contract with Jack Doheny Company for emergency procurement related to the roll off truck for the Bay View Water Reclamation Plant.
