Title
Authorizing the mayor to enter into a cooperative grant agreement with and to accept additional financial assistance from the state of Ohio, Department of Transportation (ODOT), in an amount not to exceed $166,580 for construction of the project entitled LUC-Summit Street Streetscape Phase 2; authorizing acceptance, deposit, appropriation and expenditure of the grant proceeds into the Capital Improvements Fund; authorizing the mayor to accept bids and award contracts for said project; and declaring an emergency.

SUMMARY & BACKGROUND:
This ordinance is required to enable the city of Toledo to enter into an agreement with ODOT and to accept additional funding for the project entitled LUC-Summit Street Streetscape Phase 2. The funds will be used to construct streetscape and bike path related improvements along Summit Street associated with this planned and phased streetscape enhancement project. Passage of this ordinance will allow additional grant funds in the amount of $166,580 to be added to the original grant amount of $610,364 authorized by Ordinance 161-17. Local matching funds totaling $414,180 for the project are required and will be included with the proposed Engineering Services 2019 Matches and Planning Program.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into, execute a cooperative agreement with, and accept financial assistance from the state of Ohio Department of Transportation (ODOT) for the project entitled LUC-Summit Street Streetscape Phase 2 upon terms and conditions approved by the director of public utilities and the director of law.
SECTION 2. That the mayor is authorized to accept and deposit additional grant proceeds, in an amount not to exceed $166,580 from the state of Ohio, Department of Transportation into Account Code 540G-35000-8GA7277STDSTD for construction of the project entitled LUC-Summit Street Streetscape Phase 2.
SECTION 3. That the sum of $166,580 is appropriated from the unappropriated grant proceeds in the Capital Improvement Fund into account code 540G-35000-8GA7277STDSTD; and further authorizing the expenditure of same.
SECTION 4. That the mayor is authorized to prepare plans and specifications, accept bids, and award contracts, for said project including such items as labor, materials, real estate incidentals, purchase of rights-of-way, and professional services necessary to undertake the LUC-Summit Street Streetscape Phase 2.
SECTION 5. That the finance director is authorized to draw her warrant or warrants against the above mentioned account code in an amount not to exceed $166,580 in payment of the obligation herein above authorized upon presentation of the proper voucher or vouchers.
SECTION 6. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 7. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to facilitate the construction of the project.
