SUMMARY & BACKGROUND:

The treatment of drinking water requires the use of many chemicals, some at large feed rates, to process and remove pollutants to meet regulatory requirements.  One of those chemicals is sodium fluorosilicate (fluoride).  Failure to maintain fluoride standards range of 0.7- 1.3 mg/l of fluoride for 4 days with in a month will result in a Notice of Violation from OEPA and a Tier 3 Public Notification.  Our current contract expired and it was again advertised for bid.  There was only one bidder and the company was non-conforming and we had no previous experience with them.  Sal Chemical could not bid due to the instability of the overseas market, but offered competitive prices for drop shipments.  Sufficient funds are available within the Water Operating Fund to pay for this emergency purchase.

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the mayor is authorized to enter into a contract for the purchase of 19,845 lbs. of sodium fluorosilicate (fluoride) with Sal Chemical for the purpose of water treatment.

 

SECTION 2. That this Council finds and determines it is in the best interest of the city to waive the competitive procurement requirements of TMC Chapter 187 for the reason of the current scarcity in the open market for sodium fluorosilicate.

 

SECTION 3.  That an expenditure of an amount not to exceed $22,000 is authorized from the Water Operating Fund, Account Code 6060-32000-4000500STDSTD, for the purchase of sodium fluorosilicate for the purpose of water treatment.

 

SECTION 4.  That the Finance Director is authorized to issue warrant or warrants against the account code identified in Section 3 in an amount not to exceed $22,000 in payment of the obligations incurred pursuant to the contract authorized in Section 1 upon presentation of the proper voucher or vouchers. 

 

SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate purchase of sodium fluorosilicate for water treatment and the preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to provide proper treatment of drinking water for compliance with Ohio EPA permits at the Collins Park Water Treatment Plant.
