SUMMARY & BACKGROUND:
The current contracts between the City of Toledo, the Lucas County Solid Waste Management District (LCSWMD) and Republic Services expire August 31, 2026. In May of 2025, through the LCSWMD procurement process, proposals were solicited for a new refuse and recycling contract. Proposals were received from four potential providers: Republic Services, Priority Waste, LLC, Rumpke Waste and Recycling, and FCC Environmental. After formal presentations, interviews and due diligence through site visits and reference follow-ups, the Administration has determined it is in the best interest of the City to enter into a contract with Priority Waste, LLC. The proposed contract is estimated to be $13,560,000 annually for a term of five years, with the option for a five-year renewal.
Priority Waste, LLC offers an enhanced customer service experience for residents through the use of technology. With real time truck monitoring and video, route tracking, dedicated Toledo customer services contact assistance and data sharing with Engage Toledo. Priority demonstrated their understanding of the city’s needs and approach to deliver consistent, reliable, high-quality service for residents.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a five-year agreement with a five-year renewal option with Priority Waste, LLC for curbside refuse and recycling collection upon other terms and conditions acceptable by the Director of Public Service and the Director of Law.
SECTION 2. That subject to annual appropriation, the annual expenditure of an amount not to exceed $13,560,000 is authorized from the General Fund Account Code 1001-89800-1129001STDSTD for curbside refuse and recycling services.
SECTION 3. That this Council finds and determines that it is in the best interest of the City to waive the competitive formal purchasing requirements of Toledo Municipal Code Chapter 187 for the refuse and recycling contract for the reason that a competitive procurement process being recently completed by the Lucas County Solid Waste Management District involving the same city service area.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in payment of the above-authorized obligations in an amount not to exceed $13,560,000 annually upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective to continue to provide uninterrupted efficient refuse and recycling collection services to the residents of the City of Toledo.
