Title

Authorizing the expenditure of $60,100 from the Storm Water Utility Operating Fund for ditch improvements along Silver Creek Ditch; authorizing the Mayor to accept bids and enter into a contract for ditch improvements along Silver Creek Ditch; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

Approximately $60,100 is needed to install 135 feet of 36-inch PVC pipe and regrade a section along Silver Creek Ditch to alleviate and prevent standing water behind homes. The current situation causes continuous and costly flooding damages for properties along Silver Creek Ditch. The ditch improvements will be from the storm outfall located in the backyard of 3428 Grayling Place to the storm main approximately 350 feet Northeast just before property line at 5457 Secor Rd.

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1. That an amount not to exceed $60,100 is authorized for expenditure from the Storm Water Utility Operating Fund, Account Code 607A-37000-4000559STDSTD for ditch improvements along Silver Creek Ditch.

SECTION 2. That the Mayor is authorized to accept bids and enter into contracts for the purpose authorized in Section 1, upon terms and conditions acceptable to the Director of Public Utilities and Director of Law.

SECTION 3. That the Director of Finance is authorized to issue their warrant or warrants against the Account Code listed in Section 1 in an amount not to exceed $60,100 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

SECTION 4.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to permit the earliest possible construction of the ditch improvements.
