SUMMARY & BACKGROUND:
An existing 12” water main located on Nebraska Avenue between Division Street and Rogan Way was discovered to have been installed outside of the existing right-of-way. Site work on the adjacent private development began placing foundation footings, and struck the existing water main. The water main needs to be removed to continue with the site development. Two bids were obtained and came in extremely close. The Division of Engineering and Construction Management chose to go with Rudolph Libbe as they were already on-site and able to begin work more expediently.
This ordinance will allow the division to waive the formal bidding procedure in order to immediately begin removal of the existing water main in an effort to reduce costs that could arise from contractor down time, or demobilization/remobilization of labor and equipment.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a contract with Rudolph Libbe for the emergency removal of an existing 12” water main on Nebraska Avenue between Division Street and Rogan Way, upon such terms and conditions approved by the Director of Transportation and the Director of Law.
SECTION 2. That the expenditure of an amount not to exceed $34,000 from the Water Replacement Fund is authorized from Account Code 6063-35000-4UC0224STDSTD for emergency removal of an existing 12” water main on Nebraska Avenue between Division Street and Rogan Way.
SECTION 3. That this Council finds and determines that it is in the best interest of the City to waive the formal competitive bidding provision of TMC Chapter 187 for the reason that Rudolph Libbe has significant institutional knowledge of the project and was immediately ready to proceed with the removal to mitigate a potential increase in cost.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code listed in Section 2 in an amount not to exceed $34,000 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason for the preservation of costs and the progress of the private site development and its construction timelines and to timely pay the contractor for their emergency services.
