Title

Authorizing the Mayor to enter into a one-year contract with three one-year renewal options for preventative maintenance of the CAAS Cyanobacteria Analyzer at the Collins Park Water Treatment Plant; authorizing the expenditure of an amount not to exceed $15,000 from the Water Operating Fund; waiving the competitive provisions of TMC Chapter 187; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The Collins Park Water Treatment Plant utilizes a CAAS Cyanobacteria Analyzer to monitor cyanobacteria levels in the water supply. Preventative maintenance is necessary to maintain the analyzer’s accuracy, reliability, and continued operation.

Awareness Technology is the sole-source vendor for this specialized equipment and will perform the required preventative maintenance at a cost not to exceed $15,000. Waiver of the competitive provisions of TMC Chapter 187 is requested due to the sole-source nature of the service.

The Ordinance is declared an emergency to ensure the maintenance is completed promptly and the analyzer remains operational for continued water quality monitoring.

Summary

NOW THEREFORE, Be it ordained by the Council of the City of Toledo:

SECTION 1. That the Mayor is authorized to enter into a one-year contract with three one-year renewal options with Awareness Technology for the preventative maintenance of the CAAS Cyanobacteria Analyzer at Collins Park Water Treatment Plant upon terms and conditions approved by the Director of Public Utilities and the Director of Law.

SECTION 2. That subject to appropriation the annual expenditure of an amount not to exceed $15,000 is authorized from the Water Operating Fund, Account 6060-32000-4000503STDSTD for the preventative maintenance of the CAAS Cyanobacteria Analyzer at the Collins Park Water Treatment Plant.

SECTION 3. That this Council finds and determines that it is in the best interest of the City to waive the competitive provisions of TMC Chapter 187 for the reason that Awareness Technology is a sole source vendor and maintenance provider for this analyzer and purchasing a new analyzer at this time would be cost prohibitive.

SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified above in an amount not to exceed $15,000 annually in payment of the obligations authorized herein upon presentation of the proper voucher or vouchers.

SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate prompt payment to Awareness Technology for preventative maintenance of the CAAS Cyanobacteria Analyzer at the Collins Park Water Treatment Plant.
