Authorizing the appropriation and expenditure of $300,000 from the Sanitary Sewer Replacement Fund for the Plant Pumps, Motors & Valves Rebuild/Replacement Project at the Water Reclamation Facility; authorizing the Mayor to accept bids and award contracts for equipment rebuilds with nonproprietary parts or equipment replacement and for related professional, engineering, permitting, testing and construction services; waiving the competitive bidding provisions of TMC Chapter 187 for proprietary parts and equipment necessary for the completion of the Plant Pumps, Motors & Valves Rebuild/Replacement Project; and declaring an emergency.

SUMMARY & BACKGROUND:
The Water Reclamation Facility houses both a traditional activated sludge treatment facility and a wet weather treatment facility which have a combined total treatment capacity of 400 million gallons of sewage per day. The treatment facility and the collection system, including pump stations contains hundreds of pumps, valves, gates, motors, actuators, etc. In order to maintain compliance with our National Pollutant Discharge Elimination System (NPDES), this equipment needs to be maintained, repaired, and replaced as needed. The Division intends to seek formal as well as informal proposals for rebuilding and/or replacing pumps, valves, gates, motors, actuators, and other equipment as needed in order to maintain compliance with the NPDES discharge permit and to provide the necessary redundancy of such equipment at the facility and throughout the collection system. Some equipment will require the purchase of proprietary parts for repair or rebuild and others can only be purchased from authorized sole sources. For that, the Division is requesting a waiver of all competitive bidding provisions of TMC Chapter 187.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of $300,000 from the unappropriated balance of the Sewer Replacement Fund is authorized to Account Code 6073-36000-4UC2726STDSTD for the completion of the Plant Pumps, Motors & Valves Rebuild/Replacement Project at the Water Reclamation Facility; and the expenditure of the same is authorized.
SECTION 2. That the Mayor is authorized to accept bids and award contracts for equipment rebuilds, equipment replacement and for professional, engineering, permitting, testing and construction services necessary for the completion of the Plant Pumps, Motors & Valves Rebuild/Replacement Project at the Water Reclamation Facility, upon terms and conditions approved by the Director of Public Utilities and the Director of Law.
SECTION 3. That this Council finds and determines when necessary, it is in the best interest of the City to waive all competitive bidding provisions of TMC Chapter 187 for equipment rebuilds with proprietary parts or equipment replacement from authorized sole sources.
SECTION 4. That the Finance Director is authorized to issue warrant or warrants against the Account Code listed in Section 1 in the amount of $300,000 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the Plant Pumps, Motors & Valves Rebuild/Replacement Project at the Water Reclamation Facility.
