Title
Authorizing the Mayor to enter into an amended contract with Core and Main, LP. for the purchase of hydrants and valve boxes for water main replacement projects; waiving the competitive bidding requirements of TMC Ch. 187; and declaring an emergency.

SUMMARY & BACKGROUND:
The City entered into a contract, authorized by Ordinance 09-22, with Core and Main to supply ductile iron pipe, fittings and gate valves for water main replacement projects. The supplier was retained through a competitive bid process.
Hydrants and valve boxes for the projects are unavailable from the Division of Water Distribution’s supplier, from whom the hydrants and valve boxes were to be obtained. Hydrants and valve boxes are immediately available from Core and Main. Water main replacement projects are currently underway; the water main portion of the projects must be completed on schedule so that subsequent roadway construction projects may be completed on schedule.
These items are best supplied by Core and Main since they are supplying the remainder of the equipment for water main replacement projects. Amending the scope of work of the existing Core and Main contract is in the best interest of the City as it will reduce construction costs and time.
Funding for the hydrants and valve boxes is available from the Water Replacement Fund.
This work is necessary to maintain safe, reliable service that will meet the demands of the City of Toledo water distribution system.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into an amended contract with Core and Main, LP. for the purchase of hydrants and valve boxes, with such additional purchases to be paid for with funds appropriated and authorized for expenditure under Ordinance 09-22.
SECTION 2. That this Council finds and determines it is in the City’s best interest to waive the competitive procurement requirements of Toledo Municipal Code Chapter 187 to procure the hydrants and valve boxes from Core and Main, LP. for the reason that amending the contract with Core and Main, LP. will save both time and money due to the interrelatedness of the work and the fact that the original contract was awarded through a competitive process.
SECTION 3. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to meet water main replacement project and subsequent road construction project schedules and deadlines.
