SUMMARY & BACKGROUND:
The Division of Road and Bridge Maintenance has been working with AT&T Ohio to relocate a set of communication lines owned by AT&T Ohio as part of the Secor Road Bridge over Ottawa River project. Ordinance 492-22 authorized acceptance of $234,055 for the project. An additional $28,445 is needed to complete the AT&T Ohio work. This ordinance authorizes the Mayor to amend the cooperative agreement with AT&T Ohio in order to accept additional funds.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to amend the cooperative agreement with and to accept additional financial assistance from AT&T Ohio for the construction of Secor Bridge over the Ottawa River Project upon such terms and conditions as approved by the Director of Transportation and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds from AT&T Ohio into the Capital Improvement Project Fund Account Code 540G-23100-GA7811STDSTD in an amount not to exceed $28,445 for the construction of Secor Bridge over the Ottawa River Project.
SECTION 3. That an amount not to exceed $28,445 is appropriated from the unappropriated grant proceeds in the Capital Improvement Project Fund to the account code listed above; and that this amount is authorized for expenditure for the purposes set forth herein.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the above account code in an amount not to exceed $28,445 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to meet project deadlines for the construction of Secor Road Bridge over the Ottawa River Project.
