SUMMARY & BACKGROUND:
This ordinance authorizes a lease contract with Rent.Fun to install and operate kayak rental lockers at Cullen Park. The total cost of the 5-year contract is $35,000, which shall be paid as a one-time, up-front activation fee. Rental income collected by the operator would be split 50/50 between the operator and the city during the contract term, with the option to renew the lease contract at no additional cost to the city. Rent.Fun is responsible for installing and maintaining the lockers, purchasing and maintaining the necessary equipment, and performing all other duties related to the rental process with customers, including software set-up, payment processing, signage, marketing, and customer service.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a contract with Rent.Fun for the establishment and operation of kayak rental lockers at Cullen Park upon terms and conditions acceptable to the Director of Law and the Director of Parks and Youth Services.
SECTION 2. That the expenditure of an amount not to exceed $35,000 is authorized from the General Fund Account Code 1001-40100-7000315STDSTD to execute a 5-year contract for the services described in section 1.
SECTION 3. That the receipt of the rental income split equally over the term of the contract may be accepted and deposited as recoupment into the General Fund Account Code 1001-40100-7000315STDSTD.
SECTION 4. That this Council finds and determines it is in the best interest of the City to waive the competitive provisions of TMC Chapter 187 for the reason that Rent.Fun is the sole-source vendor for turnkey kayak rental services.
SECTION 5. That the Director of Finance is authorized to issue warrant or warrants against the above-authorized Account Codes in payment of the obligations authorized in Section 1 upon presentation of proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this ordinance must be immediately effective in order to realize the full benefit of the services for the upcoming Spring 2025.
