SUMMARY & BACKGROUND:
The Division of Road and Bridge Maintenance has successfully applied for and received funding from ODOT to rehabilitate the Berdan Avenue over Ottawa River Bridge. The City of Toledo will administer the construction of the project. Matching funds will be provided through the Division of Road and Bridge Maintenance Matches and Planning fund. Construction is scheduled to begin in 2027.

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1. That the Mayor is authorized to enter into and execute a cooperative agreement with and to accept and deposit financial assistance from the State of Ohio Department of Transportation (ODOT) in the amount of $2,093,046 for the Berdan Avenue over Ottawa River Bridge project upon such terms and conditions as approved by the Director of Transportation and the Director of Law.
SECTION 2. That the appropriation of an amount not to exceed $2,093,046 is authorized from the unappropriated grant proceeds in the Capital Improvement Fund to Account Code 540G-23100-8GA8663STDSTD; and the expenditure of the same is authorized for the purpose authorized in Section 1.
SECTION 3. That the Mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids for the Berdan Avenue over Ottawa River bridge project including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way and construction. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the Account Codes identified in Section 2 in an amount not to exceed $2,093,046 for construction in payment of the obligations incurred pursuant to the contracts authorized in Section 3 upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of these projects.
