Title
Authorizing the Mayor to enter into an agreement with and accept financial cooperation from the Toledo Area Regional Transit Authority in an amount not to exceed $300,000 for the TARTA LITE program; authorizing the acceptance, deposit, appropriation, and expenditure of proceeds into the Capital Improvement Project Fund in an amount not to exceed $300,000 for said program; authorizing the Mayor to prepare plans and specifications, acquire required rights-of-way as appropriate, and enter into contracts for said project; and declaring an emergency.

SUMMARY & BACKGROUND:
In conjunction with the Vistula Manor upgrade project, the TARTA LITE program will install enhancements to the bus stop at Huron Street adjacent to the Vistula Manor property, including sidewalk and curb improvements along with the installation of TARTA-supplied shelters. The program will also include signage installation and continue the access improvements (walks/benches) for safer and more comfortable transit access.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute an agreement with the Toledo Area Regional Transit Authority for the TARTA LITE program upon such terms and conditions as approved by the Director of Transportation and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit proceeds from the Toledo Area Regional Transit Authority into the Capital Improvements Project Fund into Account Code 5040-35000- 8CP2522BUSBNH in an amount not to exceed $300,000 for the TARTA LITE program.
SECTION 3. That an amount not to exceed $300,000 is appropriated from the unappropriated balance of the Capital Improvement Fund into Account Code 5040-35000- 8CP2522BUSBNH for the TARTA LITE program; and further authorizing the expenditure of same.
SECTION 4. That the Mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids for the TARTA LITE program as necessary to complete the improvements identified above including such items as labor, materials, construction testing, professional services, and for property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way as required. Contracts shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.
SECTION 5. That the Director of Finance is authorized to issue their warrant or warrants against the account codes listed in Section 2 above in an amount not to exceed $300,000 in payment of the obligations upon presentation of the proper voucher or vouchers.
SECTION 6. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 7. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to facilitate this work to improve the safety and access to TARTA buses.
