Central Avenue; authorizing the Mayor to accept bids for services and execute agreements and contracts as necessary and appropriate associated with the purchase and improvement of said property; and declaring an emergency.

SUMMARY & BACKGROUND:

In order for the redevelopment of 1030 Water Street to occur, Road and Bridge Maintenance operations needed to be relocated.  Ord. 37-24 authorized the appropriation and expenditure of $2,000,000 from the Capital Improvement Fund for site development and renovations at 1189 W. Central and 301 N. Byrne Road for this relocation.  After bidding the construction costs, it has been realized that the cost to renovate far exceeds the available funds, and the renovations would still not provide the space and security needed for the division. 

 

Property located at 5055 Enterprise Blvd is available for sale and is found to be an excellent facility to house the division.  This ordinance will reallocate the remaining $1,792,000 appropriated for the division’s relocation to the purchase of this building and to make necessary building improvements to suit the needs of the division. 

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the disappropriation of $1,792,000 is authorized from the Capital Improvement Fund Account Code 5040-23100-8CP2406STDSTD.

 

SECTION 2. That the appropriation of $1,792,000 is authorized from the unappropriated balance of the Capital Improvement Fund to Account Code 5040-23100-8CP2520RBMBLD and the expenditure of same is authorized for the purchase of 5055 Enterprise Blvd. (Lucas County TD Parcel 2327221), together with various costs and services related thereto, including site development and renovations.

 

                     SECTION 3.  That the Mayor and the Director of Transportation are authorized to execute and deliver needed instruments for the purchase of the subject real property, to accept bids and execute contracts or agreements for various services including, but not limited to, the purchase of property located at 5055 Enterprise Blvd. (Lucas County TD Parcel 2327221), together with surveys, testing, title work, appraisals, closing costs, relocation costs, environmental assessments, necessary building improvements, and other incidental fees and expenses associated with and required for the relocation of Road and Bridge Maintenance Operations, upon such terms and conditions as shall be approved by the Director of Transportation and the Director of Law.

 

                     SECTION 4.  That the Finance Director is authorized to draw their warrant or warrants against the above stated Account Code in payment of the obligations authorized above upon presentation of proper voucher or vouchers in an amount not to exceed $1,792,000.

 

                     SECTION 5.  That it has found and determined that all formal actions of Council concerning and relating to the passage of this ordinance were adopted in open meeting of Council, and that all deliberations of Council and any of the Committees which resulted in such formal actions were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

 

                     SECTION 6.  That this Ordinance, being and emergency measure, shall take effect and be in force from and after its passage.  The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective to timely purchase and relocate the Division of Road and Bridge Maintenance to improve operations.
