SUMMARY & BACKGROUND:
Petitioner has filed a request to vacate portions of Liberty Street and Freedom Street, along with adjacent alley in the Plat of Myrtle Addition, in the City of Toledo, Lucas County, Ohio; in the City of Toledo, Lucas County, Ohio.
Summary
NOW, THEREFORE, Be it resolved by the Council of the City of Toledo:
SECTION 1. That the City Council does hereby declare its intent to vacate portions of Liberty Street and Freedom Street, along with adjacent alley in the Plat of Myrtle Addition, in the City of Toledo, Lucas County, Ohio; in the City of Toledo, Lucas County, Ohio; further described below:
“Vacating a portion of Liberty Street, having a Westerly Limit from the most southerly corner of Lot 90 to the most westerly corner of Lot 85 and an Easterly Limit from the southeasterly corner of Lot 87 to the northeasterly corner of Lot 70, all within the Plat of Myrtle Addition to the City of Toledo, State of Ohio.
together with
Vacating a portion of Freedom Street, having a Westerly Limit from the intersection of southwesterly right-of-way of Freedom Street with the northwesterly limits of a Plat in the name of Myrtle Addition to the City of Toledo to the most westerly corner of Lot 90 and an Easterly Limit from the southeasterly corner of Lot 55 to the northeasterly corner of Lot 32, all within the Plat of Myrtle Addition to the City of Toledo, State of Ohio.
together with
Vacating a portion of a 16 foot wide alley, having a Westerly Limit from the most southerly corner of Lot 85 to the most westerly corner of Lot 52 and an Easterly Limit from the southeasterly corner of Lot 76 to the northeasterly corner of Lot 57, all within the Plat of Myrtle Addition to the City of Toledo, State of Ohio.
Having a Total Area of 69,174.76 Sq. Ft. or 1.5880 Ac. Of Land”
SECTION 2. That this matter be referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date.
SECTION 3. That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its adoption. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective so that the vacation can be expeditiously completed to enable property owners to obtain the resulting benefits at the earliest time.
