Title
Authorizing the acceptance, deposit, appropriation and expenditure of an amount not to exceed $100,000 from the Village of Ottawa Hills into the Capital Improvement Fund for the reconstruction of the Central Avenue/Talmadge Road intersection and the resurfacing of Talmadge Road within the Ottawa Hills village limits related to the Central/Talmadge reconstruction project; authorizing the Mayor to prepare plans and specifications and to enter into a joint cooperation agreement with the Village of Ottawa Hills for the Central/Talmadge reconstruction project upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law; and declaring an emergency.

SUMMARY & BACKGROUND:
Ordinances 116-17 and 161-17 authorized the City of Toledo to accept and expend $1,351,388 of ODOT and OPWC funding for the widening and reconstruction of the intersection of Central Avenue and Talmadge Road scheduled for 2018. The Village of Ottawa Hills has agreed to pay for their portion of the intersection construction and desires to have an additional section of Talmadge Road resurfaced within the City’s project at the Village of Ottawa Hills’s expense. The ODOT funding will also cover their portion of the intersection and the OPWC funding will cover a portion of both the intersection reconstruction and the Talmadge Road resurfacing. The Village of Ottawa Hills has committed to reimburse the City of Toledo up to $100,000 for its portion of the cost of these improvements. There is no financial impact to the City of Toledo since Ottawa Hills is funding its portion.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a joint cooperation agreement and to accept and deposit funds in an amount not to exceed $100,000 from the Village of Ottawa Hills into Account Code 5040-35000-8CP1705STREET for resurfacing within the Village of Ottawa Hills as part of the Central/Talmadge reconstruction project.
SECTION 2. That the appropriation and expenditure of $100,000 is authorized from the Capital Improvement Fund into Account Code 5040-35000-8CP1705STREET for the Central/Talmadge reconstruction project.
SECTION 3. That the Mayor is authorized to prepare plans and specifications and to enter into contracts after accepting bids in accordance to law for the Central/Talmadge reconstruction project upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law.
SECTION 4. That the Finance Director is authorized to issue his warrant or warrants against the above listed Account Code in amounts not to exceed $100,000 in payment of the obligations incurred upon presentation of the proper voucher or vouchers.
SECTION 5. That various adjustments and line item expenditures and transfers are authorized to reimburse the Capital Improvements Fund for the reconstruction of the Central/Talmadge intersection and the resurfacing of Talmadge Road within the Village of Ottawa Hills limits related to the Talmadge Road Resurfacing project.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective to accept funding from the Village of Ottawa Hills for the Central/Talmadge Reconstruction project.
