SUMMARY & BACKGROUND:

Ordinances 418-16 and 352-17 authorized the appropriation and expenditure of funds for the purchase of vehicles for the division of sewer and drainage services. The city of Toledo ordered 11 Ram trucks from Vision Chrysler in Defiance, Ohio under state-term contract.  After the trucks were built and ready for shipment, Vision Chrysler went out of business.  A Fiat Chrysler Americas fleet manager contacted Charlie's Dodge and requested they fulfill delivery of the trucks at the same cost as originally awarded.  Charlie’s Dodge agreed to maintain the pricing and complete the delivery. This ordinance authorizes the Mayor to enter into a contract with Charlie’s Dodge for said purchase.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the Mayor is to award a contract to Charlie’s Dodge for the purchase of 11 Dodge Ram pick-up trucks for the division of sewer and drainage services.

 

SECTION 2. That the competitive procurement requirements of TMC 187 are waived for the purchase of pick-up trucks from Charlie’s Dodge for the reason that the vendor originally selected is no longer in business and that Charlie’s Dodge is a local vendor and has agreed to maintain the same pricing as the previous vendor.

 

SECTION 3.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this ordinance must be immediately effective in order to complete the purchase and acquisition of the pick-up trucks for uninterrupted sewer and drainage service operations.
