SUMMARY & BACKGROUND:
It is the intent of this ordinance to appropriate and expend $119,684 ($59,842 from the Sewer Replacement Fund, and $59,842 from the Water Replacement Fund) for the purchase of a replacement GC-MS trace organic substance analyzer system at Environmental Services. This critical and essential expenditure will replace equipment that is twenty (20) years old. In addition, this trace organic substance analyzer is essential and critical to complying with the Ohio EPA National Pollutant Discharge Elimination Systems (NPDES) permit for the federal, state and local regulations for the Pretreatment program. Bids for said equipment have been received and Agilent Technologies, Inc. has been selected as the best bidder according to the guidelines of the TMC Chapter 187. Sufficient funds have been provided in the DPU CIP replacement plans for Sewer and Water.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation in an amount not to exceed $59,842 is authorized from the unappropriated balance of the Sewer Replacement Fund, and $59,842 from the unappropriated balance of the Water Replacement Fund into to the account codes listed below for the purchase of new GC-MS equipment; and further authorizing the expenditure of same.

SECTION 2. That the mayor is authorized to enter into an agreement for the purchase of one GC-MS trace organic substances analyzer system not to exceed a total amount of $119,684.
SECTION 3. That the Finance Director is authorized to draw warrant or warrants in an amount not to exceed $59,842 from the Sewer Replacement Fund Account Code 6063-38000-4UC1621STDSTD and an amount not to exceed $59,842 from the Water Replacement Fund Account Code 6073-38000-4UC1621STDSTD, in payment of the obligations authorized in Section 2 upon presentation of proper voucher or vouchers.
SECTION 4. That the disappropriation of any remaining budget to fund balance at project closeout is authorized.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the same is necessary for the immediate preservation of the public peace, health, safety and property, and for further reason that the replacement of the aging trace organic substance analyzer is necessary for continued compliance with the Ohio EPA National Pollutant Discharge Elimination Systems permit.
