Authorizing the settlement of  a property damage claim of Watercrest Home Owner’s Association (“HOA”); authorizing the expenditure of $11,859.89 from the Risk Management Fund; and declaring an emergency.

SUMMARY & BACKGROUND:

It is alleged by the Watercrest Homeowner’s Association that City of Toledo Water Distribution personnel failed to properly turn off the water at the City’s meter box, causing the Watercrest HOA’s water pipes to freeze and to break on February 13, 2023. The total cost to repair the water pipes and sprinkler heads was $11,859.89. This Ordinance authorizes the settlement and payment of this claim.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the expenditure of $11,859.89 is authorized for payment in settlement of the claim of Watercrest HOA from the Risk Management Fund, Account Code 7095-12000-1157001STDSTD.

 

                     SECTION 2.  That the payment of this claim is contingent upon the execution of the proper release by Watercrest HOA.

 

SECTION 3.  That the Director of Finance is authorized to draw warrant or warrants to the Watercrest HOA in the sum of $11,859.89 against the Account Code listed in Section 1 upon presentation of the proper voucher or vouchers.

 

                     SECTION 4.  That this Ordinance, being an emergency measure, shall be in force and effect from and after its passage.  The reason for the emergency is that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to implement the settlement in accordance with the conditional agreement of the Administration.
