Amending Ordinance 544-22 by repealing Sections 2 and 4 of Ordinance 544-22 and, enacting new Sections 2 and 4 for the purpose of increasing the expenditure authority to include the costs of ancillary space use for the Toledo Fire and Rescue fire academy; and declaring an emergency.

SUMMARY & BACKGROUND:
Ordinance #544-22 permitted a 5-year space usage lease agreement with Owens Community College for Fire’s Academies and Departmental training ends but limited related expenditures to lease payments, which did not account for Ancillary Space usage fees, as stated in Section 1 of the original agreement.
This Ordinance requests to incorporate the same by repealing and enacting new Sections 2 and 4 of Ordinance 544-22.
Factoring in Ancillary Space Usage fees in the new Sections will increase related expenditures by no more than $26k annually and sufficiently covers years with two academies. Accordingly, annual expenditures increase from $81,675.96 to no more than $107,675.96, and total contract value increases from $408,379.80 to $538,379.80.

NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That Section 2 of Ordinance 544-22 that reads as follows:
SECTION2. That, subject to available appropriation in future years, an expenditure not to exceed $81,675.96 annually for a term of five years is authorized from the General Fund Account Code 1001-53000-533100-3341002TRAING for the purposes identified in Section 1.
is repealed.
SECTION 2. That a new Section 2 of Ordinance 544-22 that reads as follows:
SECTION 2. That, subject to available appropriation in future years, an expenditure not to exceed $107,675.96 annually for a term of five years is authorized from the General Fund Account Code 1001-53000-533100-3341002TRAING for the purposes identified in Section 1.
is enacted.
SECTION 3. That Section 4 of Ordinance 544-22 that reads as follows:
SECTION 4. That the Finance Director is authorized to draw a warrant or warrants against the above-referenced account code in an annual amount not to exceed $81,675.96 in payment of the above obligations upon presentation of proper voucher or vouchers.
is repealed.
SECTION 4: That a new Section 4 of Ordinance 544-22 that reads as follows:
SECTION 4. That the Finance Director is authorized to draw a warrant or warrants against the above-referenced account code in an annual amount not to exceed $107,675.96 in payment of the above obligations upon presentation of proper voucher or vouchers.
is enacted.
SECTION 5. This Ordinance is declared an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property, and for the further reason that this Ordinance must be immediately effective to facilitate the continued efficient operations of the TFRD fire academy.
