SUMMARY & BACKGROUND:
Water Distribution located a leak on the 30-inch concrete transmission main located on Glanzman Road. This main is the primary source of water for the area. The Division deemed this an emergency due to the large number of residents that would be negatively affected if the main’s condition were to worsen. The Division requested quotes on an emergency basis. The repair will include shoring the excavation to ensure safe entry, removing the damaged section of pipe and replacing it and restoring the impacted area. This Ordinance authorizes the Mayor to enter into contract with Crestline Excavating and authorizes payment for said materials and labor. Budget is available in the Water Replacement Fund for this purpose.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into contract with Crestline Paving and Excavating Company, Inc. for materials and labor for the repair of a 30-inch concrete transmission main, upon the terms and conditions acceptable to the Director of Law and the Director of Public Utilities.
SECTION 2. That the expenditure of an amount not to exceed $128,620 is authorized from the Water Replacement Fund Account Code 6063-34000-4UC2523STDSTD for payment for the purposes identified in Section 1.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the formal competitive provisions of the TMC Chapter 187 for the reason that this is an emergency that could not have been reasonably foreseen and would result in an interruption or detriment to utility services.
SECTION 4. That the Director of Finance is authorized to issue their warrant or warrants against the Account Code above in the amounts not to exceed those authorized above in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the City and for the further reason that this Ordinance must be immediately effective in order to permit the earliest possible repair of critical elements in the City of Toledo’s Water Distribution System.
