Title

SUMMARY & BACKGROUND:

On January 17, 2024, the Council of the City of Toledo passed Ordinance No. 17-24 granting a Special Use Permit (SUP-8002-23) for a new gas station located at the northeast corner of Dorr Street and Interstate 475.

 

Due to delays experienced by the applicant, the Special Use Permit granted by Ordinance No. 17-24 will expire January 22, 2025 pursuant to T.M.C. §1111.0707 because the conditions have been unable to be met. Applicant has requested from City Council a 6-month extension of the Special Use Permit until July 21, 2025 in order to allow additional time so that the project may be completed. Such extension is permitted with Council's approval.  

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.   That the Special Use Permit granted by Ordinance No. 17-24 (SUP-8002-23) for a New Gas Station located at the northeast corner of Dorr Street and Interstate 475, Toledo, Ohio, is hereby extended for an additional 6 months pursuant to T.M.C. §1111.0707(A)(4).

                     

                     SECTION 2.  That all conditions and provisions set forth in Ordinance No. 17-24 shall remain in full force and effect.

 

                     SECTION 3.  That this Ordinance hereby is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the Ordinance must be immediately effective in order to provide for the orderly regulation and use of the property and to protect the land value in the area.
