Summary

SUMMARY & BACKGROUND:

Petitioner has filed a request to vacate the 15 feet wide Alley adjacent to Lot 17 and Lot 18 in Clifton Park, located in the City of Toledo, Lucas County, Ohio.

 

NOW THEREFORE, Be it resolved that:

 

                     SECTION 1:                      That the City Council does hereby declare its intent to vacate the 15 feet wide Alley adjacent to Lot 17 and Lot 18 in Clifton Park, located in the City of Toledo, Lucas County, Ohio, further described below:

 

PARCEL ID - 03-14198

Being a parcel of land situated in Lots 17 & 18 located in the plat name of “Clifton Park” as recorded at the Lucas County Recorder’s Office in Volume 6, Page 54 of Plats, all within the City of Toledo, Lucas County, Ohio, more fully described as follows:

Beginning at the Southwest corner of said Lot 17 as determined by a survey done by Landtech Professional Surveying & Engineering in 2012, said point being the POINT OF BEGINNING;

Thence North 32˚23’52” East on the West line of said Lot 17 a distance of 55.00 feet to a point where an iron rebar with cap was set in 2012:

Thence South 57˚36’08” East a distance of 60.46 feet parallel with the South Right-of-Way of Baxter Street to a point where an iron rebar with cap was set in 2012:

Thence South 32˚23’52” West a distance of 55.00 feet parallel with the West line of said Lot 17 to a point on the North Right-of-Way of a 15 feet wide Alley where an iron rebar with cap was set in 2012:

Thence North 57˚36’08” West a distance of 60.46 feet on said North Right-of-Way of a 15 feet wide Alley to a point where an iron rebar with cap was set in 2012, said point being the POINT OF BEGINNING.

The area described above contains 3335.2000 Square Feet or 0.0765 Acre of land more or less, subject to all legal highways, leases, easements and restrictions of record.

Bearings determined by GPS observations as noted in “Landtech’s 2012 Survey” are for the express purpose of showing angular measurement only.

The land in the above description is contained all within Lucas County Permanent Parcel Number 03-14198 as Recorded in the Lucas County recorder’s office in Deed Number 20130812-0042496.

 

ALLEY VACATION

East-West Alley abutting all of Lot 9 and Lot 17 and parts of Lot 8 and Lot 18 located in the plat name of “Clifton Park” as recorded at the Lucas County Recorder’s Office in Volume 6, Page 54 of Plats, all within the City of Toledo, Lucas County, Ohio, more fully described as follows:

A 15 feet wide Alley Beginning at the West Line of said Lot 17 extended south and terminating 60.46 feet Southeasterly as measured on the Southwesterly property line of said Lot 17 and Lot 18 as shown in a survey done by Landtech Professional Surveying & Engineering in 2012.

 

                     SECTION 2.  That this matter be referred to the Toledo City Plan Commission for its review, recommendation and appropriate hearing date.

 

                     SECTION 3.  That this Resolution hereby is declared to be an emergency measure and shall be in force and effect from and after its adoption.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Resolution must be immediately effective so that the vacation can be expeditiously completed to enable property owners to obtain the resulting benefits at the earliest time.
