SUMMARY & BACKGROUND
The Historic Woodlawn Cemetery Foundation has identified the need to replace a deteriorated culvert structure in the cemetery located along Bowen Ditch. Collapse of the culvert would eliminate the only vehicle crossing within the cemetery along with blocking the water movement to the Ottawa River.
The Historic Woodlawn Cemetery Foundation will administer the design and construction of the project and pay for a majority of the construction. The City of Toledo will participate in the costs by paying a lump sum amount of $90,000, to be paid for with Storm Water Utility Improvement Funds, which is approximately 35% of the total cost of $254,811. These funds have been authorized previously as part of the annual storm water program.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into and execute cooperative agreements between the City of Toledo and the Historic Woodlawn Cemetery Foundation for the replacement of the culvert in Woodlawn Cemetery upon terms and conditions acceptable to the Director of Transportation and the Director of Law.
SECTION 2. That the City of Toledo gives consent to the Historic Woodlawn Cemetery Foundation to complete the above described improvements.
SECTION 3. That the City of Toledo gives consent to and shall cooperate with the Historic Woodlawn Cemetery Foundation in connection with the above described project as follows:
1) The City of Toledo agrees to contribute $90,000 to the replacement of the culvert.
2) The Historic Woodlawn Cemetery Foundation agrees to be the lead agency and to administer the construction phase of this project.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to permit timely construction for the above project.
