SUMMARY & BACKGROUND:

 

This Ordinance authorizes the city to accept a grant in the amount of $931,152.16 and enter into a grant agreement with the Ohio Emergency Management Agency. The grant is from FEMA’s Building Resilient Infrastructure and Communities (BRIC) program. OEMA is the designated Recipient to receive, administer, and disburse these FEMA funds for local government projects. Matching funds for this grant have been included in the 2025 Capital Improvement Budget.

 

This grant will help the City of Toledo to stabilize a failing embankment on Wright Avenue adjoining Swan Creek and repair associated infrastructure damage, to protect residents’ access to their homes and preserve property values. During major rainfalls, Swan Creek experiences significant high-water events and flooding. As a result, the embankment at the bend along Nelson Avenue and Wright Avenue has experienced significant erosion, damaging the roadway and placing residential property at risk. Since 2009, guardrails has been installed along the roadway three separate times, only to be washed down the embankment, and nearly half the width of the roadway pavement has been lost. If the embankment is not stabilized, continued erosion will force the closure of the roadway. Furthermore, the water line and sanitary sewer along Wright Avenue will be impacted, disrupting those utility services. The requested funds will support the construction of a king and plug pile system with a lagging wall to stabilize the upper portion of the embankment and allow reconstruction of the roadway to its original width.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to enter into a grant agreement with the Ohio Emergency Management Agency and accept and deposit a grant in the amount of $931,153 into the Capital Improvement Fund Account Code 540G-23100-8GA8645STDSTD for the Wright Avenue embankment stabilization project.

 

                     SECTION 2. That the appropriation of $931,153 is authorized from the unappropriated grant proceeds of the Capital Improvement Fund to Account Code 540G-23100-8GA8645STDSTD and expenditure of the same is authorized for the Wright Avenue embankment stabilization project.

 

SECTION 3. That the Mayor is authorized to accept bids and award contracts for the purposes authorized above, upon terms and acceptable to Director of Transportation and the Director of Law.

 

SECTION 4. That the Director of Finance is authorized to issue warrant or warrants against the above-mentioned Account Code in an amount not to exceed that authorized above in payment of the obligations authorized above by the terms of the grant upon presentation of the proper voucher or vouchers.

 

SECTION 5.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this ordinance must be immediately effective in order to timely administer the grant.
