Title
Authorizing the appropriation and expenditure in an amount not to exceed $124,500 from the unappropriated balance of the Sewer Replacement Fund for continued professional services related to the Bay View Water Reclamation Plant Wide Facilities Plan; authorizing the Mayor to enter into an agreement for professional engineering services with Arcadis to facilitate the Blue Ribbon Panel to recommend the optimal path forward and finalize the Facilities Plan; waiving the competitive procurement provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
The Division of Water Reclamation contracted with Arcadis to complete a Plant Wide Facilities Plan (Plan) to guide necessary improvements at the Bay View Water Reclamation Facility over the next 15 to 20 years through Ordinance No. 251-21. The initial report was completed and a supplemental agreement for an additional study of improved technologies for the processing of biosolids was entered into with Arcadis. Due to regulatory uncertainty and to confirm the Department is moving forward in the best interest of the residents prior to promulgating new sewer rates a Blue Ribbon Panel was convened to review, comment and make recommendations on the Plan. As the original engineering consultant on the Bay View Water Reclamation Plant Wide Facilities Plan, Arcadis is best positioned to organize and facilitate the Blue Ribbon Panel in an efficient and economical manner.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the appropriation of an amount not to exceed $124,500 is authorized from the unappropriated balance of the Sewer Replacement Fund to Account Code 6073-36000-4UC2924STDSTD to pay for additional professional engineering services to facilitate the Blue Ribbon Panel to complete the Plant Wide Facilities Plan at the Division of Water Reclamation, and that the expenditure of the same amount is authorized.
SECTION 2. That the Mayor is authorized to enter into a professional engineering services agreement with Arcadis to pay for professional engineering services for facilitating the Blue Ribbon Panel and completing the Bay View Water Reclamation Plant Wide Facilities Plan at the Division of Water Reclamation, upon terms and conditions acceptable to the Director of Law and the Director of Public Utilities.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive procurement provisions of TMC Chapter 187 for the reason that Arcadis is the original engineering consultant on the Bay View Water Reclamation Plant Wide Facilities Plan and is best positioned to provide additional professional engineering services related to the Plan and to organize and facilitate the Blue Ribbon Panel in an efficient and economical manner.
SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 1 in an amount not to exceed $124,500 in payment of the obligations authorized herein upon presentation of the proper voucher or vouchers.
SECTION 5. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain the operational integrity of the Bay View Water Reclamation Plant, and to maintain compliance with the Ohio EPA NPDES discharge permit.
