Title

Authorizing the Mayor to enter into contracts for professional and general maintenance services, including the replacement of parts and materials associated with the Allen Bradley Electrical Equipment Preventive Maintenance Project at the Division of Water Reclamation; authorizing the appropriation and expenditure of $600,000 from the Sanitary Sewer Replacement Fund for the Allen Bradley Electrical Equipment Preventive Maintenance Project at the Division of Water Reclamation; waiving the competitive bidding provisions of TMC Chapter 187 to execute contracts with either the original equipment manufacturer, Rockwell Automation, or their local authorized sales and repair representative, McNaughton-McKay Electric Company; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The Division of Water Reclamation (Division) standardizes with Allen Bradley variable frequency drives (VFDs) and electrical soft starters to control critical mechanical equipment. VFDs are used to vary and control the speed of pumps, compressors, blowers, etc. without causing any interruptions to the operation, whereas soft starters are used to reduce the electrical inrush current when starting mechanical equipment to avoid overloading electrical systems. The Division has been reliably using Allen Bradley VFDs and soft starters at the Bay View Water Reclamation Plant and the major pump stations for over 20 years. The Division did install VFDs and soft starters built by other companies, but was not successful due to electrical and control problems and lack of technical support. VFDs and soft starters normally have a service life of 20 years. With proper preventive maintenance, service life can be extended by another 5 to 10 years, which saves the Division a great deal of money and provides a reliable and uninterruptable operation. These services can only be provided by the Rockwell Automation or McNaughton-McKay Electric Company. The latter is approved as a sole service provider for Allen Bradley equipment under Ordinance 232-19. For that, it is imperative that City Council authorizes the waiver of all competitive bidding provisions of TMC Chapter 187.20.

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1. That the Mayor is authorized to enter into contracts with either the original equipment manufacturer, Rockwell Automation, or their local authorized sales and repair representative, McNaughton-McKay Electric Company, for professional and general maintenance services associated with the Allen Bradley Electrical Equipment Preventive Maintenance Project at the Division of Water Reclamation, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.

SECTION 2. That the appropriation of $600,000 is authorized from the unappropriated balance of the Sanitary Sewer Replacement Fund into Account Code 6073-36000-4UC3325STDSTD for professional and general maintenance services associated with the Allen Bradley Electrical Equipment Preventive Maintenance Project at the Division of Water Reclamation; and that the expenditure of the same is authorized.

SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive bidding provisions of TMC Chapter 187 for the reason that Rockwell Automation is the original equipment manufacturer of Allen Bradley VFDs and soft starters, and that McNaughton-McKay Electric Company is their local authorized sales and repair representative.

SECTION 4. That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 2 in the amount of $600,000 in payment of the obligations authorized herein upon presentation of the proper voucher or vouchers.

SECTION 5.  That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

SECTION 6. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to maintain the operational integrity of the Allen Bradley Variable Frequency Drives and Soft Starters at the Bay View Water Reclamation Plant and the major pump stations.
