SUMMARY & BACKGROUND:
This ordinance authorizes the waiving of competitive bidding and the purchase of a pre-owned Toro GR3150 Gas Power Greens Mower and a pre-owned Toro RM3100-D with side-winder from Century Equipment to replace two mowers that were on loan from the City’s previous golf course management company. This pre-owned equipment currently is available from a local dealer, is in good condition and is difficult to otherwise obtain in this industry, thus this legislation is an emergency measure and requests the waiver of competitive bidding.
Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter a contract with Century Equipment for the purchase of two pre-owned Toro mowers, upon such terms and conditions as acceptable to the Director of Parks and Youth Services and the Director of Law.
SECTION 2. That the expenditure of $59,350 is authorized from the Capital Improvement Fund Account Code 5040-40100-8CP2327PRKINF for the purposes identified in Section 1.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the formal competitive procurement requirements of Toledo Municipal Code Chapter 187 for the reasons that this purchase is from a local dealer and quality, pre-owned equipment is difficult to obtain, and bidding competitively for used mowers would be highly unlikely to identify comparable products in the vicinity at a lower competitive price, in the timeframe needed.
SECTION 4. That the Finance Director is authorized to draw their warrant or warrants against the above Account Code in an amount to exceed $59,350 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective in order to advance consistent maintenance of the municipal golf courses for the benefit of residents.
