SUMMARY & BACKGROUND:

In compliance with Toledo Municipal Code (TMC) Chapter 927, Section 927.13 and Part Nine, Title Three, Appendix C Section 100.07, whenever a building is demolished, sewer and water is taken out of service, the connection to the public sewer and water services is plugged (killed) at the tapping or opening into the public sewer/water main.  To provide this process, the Division of Sewer and Drainage Services executes unit base contracts to perform sewer and water service kills for the City of Toledo and private demolition projects through utilization of the Sewer Operating Fund and the Water Operating Fund. Contractors are identified through a competitive process through TMC Chapter 187.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the Mayor is authorized to execute a one (1) year contract with the option for two one (1) year extensions for water and sewer kills, upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law.

 

                     SECTION 2. That an expenditure in an amount not to exceed $336,298 is authorized from the Water Operating Fund, Account Code 6060-37000-4000512WTRKIL, for city water kills, an expenditure in an amount not to exceed $289,852 is authorized from the Sewer Operating Fund, Account Code 6070-37000-4000558STDSTD, for city sewer kills, and an expenditure in an amount not to exceed $318,850 is authorized from the Sewer Operating Fund, Account Code 6070-37000-4651006SWRKIL, for private sewer kills.

 

SECTION 3.  That the Finance Director is authorized to issue warrant or warrants against the above-mentioned account codes in amounts not to exceed those authorized above in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

                     SECTION 4.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to allow for the timely water and sewer kills.
