SUMMARY & BACKGROUND:

The City of Toledo is required by its National Pollutant Discharge Elimination System (NPDES) Permit with the Ohio EPA to update its Stormwater Management Plan and associated sections of the Toledo Municipal Code on a regular basis to be compliant with multiple state and federal requirements. This contract will be used to secure an environmental consultant familiar with these requirements who will update the Plan and TMC as needed.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That subject to annual appropriations the expenditure of an amount not to exceed $100,000 over a three-year period is authorized from the Stormwater Operating Fund Account Code 607A-38000-4000552STDSTD for the purposes of securing an environmental consultant to update the City’s Stormwater Management Plan and appropriate sections of the TMC, and associated items as required by the City’s NPDES permit.

 

SECTION 2.                      That the Mayor is authorized to accept bids and execute necessary contracts for the purpose authorized in Section 1, upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.

 

SECTION 3.                      That the Director of Finance is authorized to issue warrant or warrants against the Account Code above in amounts not to exceed those authorized above in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.  

 

SECTION 4.                      That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this ordinance must be immediately effective in order to implement this program within the Ohio Environmental Protection Agency’s designated time schedule.
