Title

Authorizing the Mayor and the Director of Law to enter into professional legal service agreements for the collection of code enforcement violation fines, income tax, general, and enterprise accounts receivables; authorizing expenditures for said services; waiving the formal bidding requirements of TMC Chapter 187; and declaring an emergency.

Body

SUMMARY & BACKGROUND:

The City of Toledo is seeking to re-establish professional collection services to enhance its collection efforts and increase City revenues.  The City previously contracted with various firms which specialize in collection services. The Department of Law recently surveyed professional collections service providers and identified select firms that provide this service at a competitive rate, satisfying the City’s criteria for collection services and cost. Given the history of successful collections at a competitive industry rate, the City would be best served to once again contract with the available qualified outside legal collection services and waive the formal competitive bidding requirements of Toledo Municipal Code Chapter 187.

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1.                      That the Mayor is authorized to enter into professional services agreements with outside legal representation for services to effectuate the collection of code enforcement violations, income tax, general, and enterprise accounts receivables. That the agreements shall be for a period of up to three (3) years, with the City’s option for a renewal for an additional three (3) year term.  That the agreements shall contain other such terms and conditions as the Mayor and the Director of Law deem to be in the best interest of the City.

SECTION 2.                      That the Finance Director is authorized to pay the fees specified in the agreements for the purposes stated.

SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the formal bidding requirements of TMC Chapter 187 for the reason that the available professional service providers offer collection services at a competitive rate and will do so subject to the collection fees set forth in TMC Chapter 187.41.

SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in full force and effect from and after its passage.  The reason for the emergency lies in the fact it is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that the ordinance must be immediately effective to enable the City to most efficiently pursue its overall city-wide collection efforts.
