SUMMARY & BACKGROUND:

Ordinance No. 052-24 authorized the mayor to execute a jurisdictional agreement regarding the provision of countywide advanced life support emergency medical services. Over the last year, Lucas County has been working to transition this responsibility to the participating political subdivisions, including the City of Toledo. The building, located at 129 21st Street, operated as an annex service building abutting the Lucas County Emergency Medical Service properties.  Lucas County has offered the “Annex” building to the City for $1.00 as it is no longer needed to house county emergency vehicles and personnel.  The building location, garage bays and office space will be a valuable and operational asset to the fire and rescue department.

 

The City will grant an easement to the County for access and maintenance of the County’s generator located on the subject property.

 

The City and the County will enter into a reciprocal parking agreement for the subject property and the abutting Lucas County emergency services properties.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to enter into a purchase agreement and to execute and deliver all needed instruments for the purchase, conveyance and acceptance of the real estate located at 129 21st Street Toledo Ohio (Parcel 14-39121) as shown and described on Exhibit A.

 

SECTION 2.  That the Mayor is authorized to execute a grant of easement to Lucas County to provide for access and maintenance of the County generator located on the subject property, as depicted and described on Exhibit B.

 

SECTION 3.                     That the Mayor is authorized to enter into a reciprocal parking agreement.

 

                     SECTION 4.  That the Mayor is authorized to accept any related property, including but not limited to personal property, office equipment, emergency vehicles, medical supplies and other necessities for the continued operation of the building known as the EMS Annex and that the agreement and needed instruments shall contain other terms and conditions deemed necessary and proper by the Mayor and the Director of Law.

 

SECTION 5.  That the Mayor and the Director of Law are authorized to execute and accept such agreements, deeds, certifications, access easements and any other instruments and to take such other lawful action as may be necessary or appropriate in order to carry out the purposes authorized herein.

 

                     SECTION 6.  That it is found and determined that all formal actions of Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of Council and that all deliberations of Council and any of its committees that result in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22, Ohio Revised Code.

 

SECTION 7.  That this Ordinance is declared to be an emergency measure and shall take effect and be in force immediately from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this Ordinance must be immediately effective to facilitate the purchase, acceptance and conveyance of the property.
