SUMMARY & BACKGROUND:
Mr. Temple purchased bus benches in accordance with an agreement with the City of Toledo but was subsequently required to remove them. A settlement agreement resolving all Mr. Temple’s possible claims related to this agreement in the amount of $40,000 has been reached conditioned on the approval of City Council and the Mayor.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That payment of $40,000 in settlement of Mr. Temple’s claims is authorized from the Risk Management Fund Account Code 7095-12000-1157001STDSTD.
SECTION 2. That payment of these claims is contingent upon the execution of the proper releases by Timothy Temple.
SECTION 3. That the Director of Finance is authorized to draw their warrant or warrants to Timothy Temple, in the sum of $40,000 against the above Account Code upon presentation of the proper vouchers.
SECTION 4. That this Ordinance being an emergency measure shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property and for the further reason that this ordinance must be immediately effective in order to implement the settlement in accordance with the conditional agreement of the administration
