Approving the application to expand the Adams Street Outdoor Refreshment Area; making findings and determinations with respect thereto; and declaring an emergency.

SUMMARY & BACKGROUND:

Pursuant to the authority of Ohio Revised Code Section 4301.82, the City of Toledo, by Ordinance No. 513-15 passed December 8, 2015, approved the application to establish the Adams Street Outdoor Refreshment Area (ORA). Since its inception, the Adams Street ORA has enjoyed great success in enhancing the economic and entertainment experience for residents and visitors to the area, specifically during cultural and recreational events. By Ordinance 434-20 passed on November 17, 2020, the Adams Street ORA was renewed for an additional 5 years as required by ORC 4301.82(I)(1). To further enhance the cultural and recreational experience of the residents and visitors, expansion of the area to include the area identified in Exhibit A attached is requested. The expansion of the area is consistent with existing zoning and the existing hours of operation and rules will insure the continued public safety within the existing and expanded area.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That the existing Adams Street Outdoor Refreshment Area is hereby expanded to include that area including the street addresses as described in the Expansion Application attached hereto as Exhibit A and incorporated herein.

                     

SECTION 2.  It is hereby found and determined by the Council of the City of Toledo that  for the purpose to insure the continued public health and safety within the area that (i) the number, spacing, and type of signage designating the area, (ii) the hours of operation for the area, (iii) the number of personnel needed to insure public safety in the area, (iv) the sanitation plan that will maintain the appearance and public health in the area, and (v) the number of personnel needed to execute the sanitation plan area are identified in Exhibit B attached hereto and incorporated herein.

                     

SECTION 3.  It is hereby further found and determined by the Council of the City of Toledo that the business, artistic, cultural, and entertainment establishments located within the area will be enhanced thereby and that the uses of land within the expanded area are in accordance with the Toledo Comprehensive 20/20 Plan and Master Zoning Plan of the City of Toledo.

 

                     SECTION 4.  That the Clerk of Council is hereby instructed forthwith to provide notice as required by Ohio Revised Code Section 4301.82(F)(3) of the expansion of the Adams Street Outdoor Refreshment Area and its public health and safety requirements to the Superintendent of the Ohio Department of Commerce, Division of Liquor Control, and the Investigative Unit of the Ohio Department of Public Safety.

 

                     SECTION 5.  That this ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety, and property, and for further reason that the ordinance must be immediately effective without further delay to facilitate the expansion of the Adams Street Outdoor Refreshment Area.
