SUMMARY & BACKGROUND:
A portion of an enclosed ditch (Ditch No. 320) is cracked. Due to this structure running directly under 4034 Rohr Drive and to assure the safety of the citizens, the Department of Public Utilities (DPU) required the expertise and equipment available through a private contractor to install a structural liner. This work was put out for competitive bidding. Sufficient funds are available within the DPU operating budget to pay for this emergency sanitary sewer repair.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to accept bids and enter into contracts for the repair of an enclosed ditch running under 4034 Rohr Drive.
SECTION 2. That the sum of $35,680 is authorized for expenditure from the Storm Water Utility Operating Fund, Account Code 607A-37000-4000559STDSTD, for payment of the repair of an enclosed ditch under 4034 Rohr Drive.
SECTION 3. That the Finance Director is authorized to issue his warrant or warrants against the account code identified in Section 1 in an amount not to exceed $35,680 in payment of the above authorized obligations upon presentation of proper voucher or vouchers.
SECTION 4. That this ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property for the repair of an enclosed ditch (Ditch No. 320).
