Title
Authorizing the Mayor to enter into an amended contract with BCA Express Co. LTD for the emergency spent lime hauling, disposal and reuse services from the Division of Water Treatment’s solids dewatering facility; authorizing the expenditure of an amount not to exceed $350,000 from the Water Operating Fund; and declaring an emergency.
Body
SUMMARY & BACKGROUND:
The original Ordinance 265-26 authorized the Mayor to enter into contract(s) to facilitate the emergency services to haul, dispose and reuse spent lime from the Division of Water Treatment’s solids dewatering facility in an amount not to exceed $750,000. The purpose of the original emergency contract under ordinance 265-26 was to maintain continuous spent lime services while a formal, long-term contract is being processed and finalized. The formal contract of spent lime services has not yet been finalized and the full $750,000 previously authorized under the emergency contract has been exhausted. Therefore, an additional $350,000 is required to provide sufficient funding to continue solids dewatering operations and spent lime hauling services until the formal contract is finalized.
Spent lime is a byproduct of the water treatment process. Continued spent lime hauling, disposal and reuse is necessary to maintain the operations of Water Treatment’s solids dewatering facility and prevent interruptions in the effective management and removal of spent lime. This Ordinance authorizes the amendment of the existing emergency contract for spent lime hauling, disposal and reuse from solids dewatering facility by increasing the authorized expenditure by an amount not to exceed $350,000.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into an amended contract with BCA Express Co. LTD to haul, dispose and reuse of spent lime from the Division Water Treatment’s solids dewatering facility, upon such terms and conditions as approved by the Director of Public Utilities and the Director of Law.

SECTION 3. That the Director of Finance is authorized to issue their warrant or warrants against the Account Code in Section 2 in an amount not to exceed $350,000 in payment of the above-authorized obligations upon presentation of proper voucher or vouchers.
SECTION 4. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be effective immediately in order to continue to produce and maintain the high quality of the city’s potable water supply.
