SUMMARY & BACKGROUND:

New sewer rates were established via Ord 242-24, repealing certain sections of Toledo Municipal Code. At a Water Committee meeting held on May 28, 2025, discussion occurred as to the effects on the average customer caused by repealing the code section on winter averaging and discontinuing the practice of such. It was stated that Lucas County water customers still have the winter averaging program. This ordinance reestablishes the winter averaging for City of Toledo customers.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.  That Toledo Municipal Code Subsection 929.04(b) which reads:

 

(1) The volume charge shall be equal to one hundred percent (100%) of the metered water consumption established by a water meter reading except as noted below.  The actual or estimated volume to be billed shall be multiplied by the applicable user class total volume charge specified in Section 929.03(b).

 

(2)  In the event a meter reading is not available or, if available, is not an accurate recording of actual consumption or represents a significant change from prior consumption, the volume to be billed shall be based on one hundred percent (100%) of a volume established by the Department of Public Utilities in the manner provided in Section 929.14 until such time as the actual consumption can be determined, at which time an appropriate billing adjustment shall be made.

 

(3) In the event a user has installed a sewage meter pursuant to Section 929.07, the volume to be billed shall be based upon one hundred percent (100%) of the metered wastewater discharged to the treatment works as established by the sewage meter reading.

Is hereby repealed.

                     

                     SECTION 2.  That a new Subsection 929.04(b) of the Toledo Municipal Code relating to winter averaging:

 

(1) The volume charge shall be equal to one hundred percent (100%) of the metered water consumption established by a water meter reading except as noted below.  The actual or estimated volume to be billed shall be multiplied by the applicable user class total volume charge specified in Section 929.03(b).

 

(2) In the event a meter reading is not available or, if available, is not an accurate recording of actual consumption or represents a significant change from prior consumption, the volume to be billed shall be based on one hundred percent (100%) of a volume established by the Department of Public Utilities in the manner provided in Section 929.14 until such time as the actual consumption can be determined, at which time an appropriate billing adjustment shall be made.

 

(3) In the event a user has installed a sewage meter pursuant to Section 929.07, the volume to be billed shall be based upon one hundred percent (100%) of the metered wastewater discharged to the treatment works as established by the sewage meter reading.

 

(4) The quarterly volume charge for a single or duplex residential user shall be subject to winter

averaging provided that a water meter is utilized at the premises to measure metered water consumption and there is a regularly scheduled water consumption reading available which is suitable for determining the volume of water consumed for the first billing cycle after January 15th of each calendar year. The volume of water used in the first billing cycle after January 15th shall be the “winter average” and shall be the volume utilized for each of the subsequent three quarters. In the event that the metered water consumption established by an actual or estimated meter reading is less than the winter average volume, then the volume charge shall be established using the metered water consumption.

 

Is hereby enacted.

                     

                     SECTION 3.  That this ordinance shall take effect from and after the earliest date allowed by law.
