Title

Authorizing the Mayor to enter into a contract with Trimble Utilities for the purchase of sanitary sewer overflow monitoring equipment and services; authorizing the expenditure of an amount not to exceed $23,325; waiving the competitive bidding provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:

This ordinance authorizes the purchase of Sanitary Sewer Overflow (SSO) monitoring equipment and two years of monitoring services. The total cost of the equipment is $20,925 and the cost of monitoring services is $2,400 for two years.  Sanitary Sewer Overflow monitoring and reporting are required as part of our Consent Decree with the Ohio EPA. The Division has awarded this work in the past to Telog, which was acquired by Trimble Utilities, who is a sole-source vendor for this equipment and service.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1.                      That the mayor is authorized to enter into a contract with Trimble Utilities for the purchase of Sanitary Sewer Overflow (SSO) monitoring equipment and monitoring services upon terms and conditions acceptable to the Director of Law and the Director of Public Utilities.

 

SECTION 2.                      That the expenditure of an amount not to exceed $23,325 is authorized from the Sewer Operating Fund Account Code 6070-36000-4000507STDSTD for the purchase of Sanitary Sewer Overflow (SSO) monitoring equipment and services.

 

SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the competitive provisions of TMC Chapter 187 for the reason that Trimble Utilities is the sole-source vendor for the Sanitary Sewer Overflow (SSO) monitoring equipment and services.

 

SECTION 4.                      That the Director of Finance is authorized to issue warrant or warrants against the account codes above in amounts not to exceed those authorized above in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.  

                     

SECTION 5.                      That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this ordinance must be immediately effective in order to continue to monitor and report sanitary sewer overflows, as required by the Ohio EPA.

 

 

                     Vote on emergency clause:  yeas 10, nays 0.
