SUMMARY & BACKGROUND:
The reason for waiving competitive bidding lies in the fact that Toledo Police officers have the required knowledge, skill and certifications to perform these investigations. Private companies do not have the same resources and skills that are common to retired officers. Toledo Fire and Rescue did put out a request for bids on Planet Bids. There were two bidders, one bid $1,700 and the other bid $1,425 per background. The retired Toledo Police Officers are completing each background at $800. Additionally, neither bidder is able to perform investigations to the extent that experienced retired officers are able. This ordinance is for the term of one (1) year, commencing on the 15th day of October 2021 and terminating on the 15th day of October, 2022.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into agreements with retired Toledo Police Officers as independent contractors for the purpose of conducting employment background investigations for Toledo Fire and Rescue.
SECTION 2. That this Council finds and determines that it is in the best interest of the City that the competitive procurement requirements of Toledo Municipal Code Chapter 187 be waived for the reason that retired Toledo Police Officers have the required knowledge, skill and certifications to perform these investigations more cost effectively than previously solicited bids.
SECTION 3. That the expenditure of an amount not to exceed $650,000 over the one-year term of the agreements is authorized from the General Fund Account Code 1001-52000- 3381002STDSTD for the purpose of engaging independent contractors to conduct background investigations.
SECTION 4. That the Finance Director is authorized to draw warrant or warrants against the above-mentioned Account Code in an amount not to exceed $650,000 in payment of the above-authorized obligations upon presentation of the proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property, and to expedite the hiring of Toledo Fire and Rescue recruits.
