Title
Authorizing the Mayor to enter into a contract with Hillabrand & Sons Construction for the emergency removal and replacement of three water main valves at the intersection of Arco Dr. & Frenchmens Rd; authorizing the expenditure of an amount not to exceed $80,000 from the Water Replacement Fund; waiving the formal competitive bidding provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
Three existing 8- inch valves located at the intersection of Arco Drive & Frenchmens Road were discovered to be damaged. While excavating, Water Distribution crews could smell creosote, and work was stopped as a result. A certification is required to perform work in an excavation that contains creosote. In an effort to perform the repair in a timely manner we are requesting waiving the formal competitive bidding provisions of TMC Chapter 187 and enter into a contract with Hillabrand & Sons Construction, because they were the only contractor to provide a quote and have the required certification.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to enter into contract with Hillabrand & Sons Construction for the emergency repair of three 8” water main valves, 20 feet of pipe, a service line re-tap, and restoration work at the intersection of Arco Drive and Frenchmens Road, upon the conditions acceptable to the Director of Law and the Director of Public Utilities.
SECTION 2. That the expenditure of an amount not to exceed $80,000 is authorized from the Water Replacement Fund Account Code 6063-34000-4UC2523STDSTD for payment for the purposes identified in section 1.
SECTION 3. That this Council finds and determines it is in the best interest of the City to waive the formal competitive provisions of the TMC Chapter 187 for the reason that it was an emergency that could not have been reasonably foreseen and would result in an interruption or detriment to utility services.
SECTION 4. That the Director of Finance is authorized to issue their warrant or warrants against the account codes above in the amounts not to exceed those authorized above in payment of the obligations incurred pursuant to the above-authorized contracts upon presentation of proper voucher or vouchers.
SECTION 5. That this Ordinance is declared to be an emergency and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the City and for the further reason that this Ordinance must be immediately effective in order to permit the earliest possible repair of critical elements in the City of Toledo’s Water Distribution System.
