Title

Authorizing the mayor to enter into an agreement with the U.S. Environmental Protection Agency; authorizing the mayor to accept, deposit an amount not to exceed $120,487 into the Water Replacement Fund for the cleanup and remediation of soil impacted due to oil in abandoned pipelines on York Street; authorizing the appropriation and expenditure of said funds; and declaring an emergency.

SUMMARY & BACKGROUND:

While installing a new water main on York Street, residual oil was found in abandoned pipelines crossing the road.  The abandoned lines were capped and removed within the York Street rights-of-way and all impacted soil in the area was remediated.

 

The fiscal impact of this ordinance is as follows:

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the mayor is authorized to enter into a grant agreement with the U.S. Environmental Protection Agency and to accept and deposit grant proceeds in an amount not to exceed $120,487 into the Water Replacement Fund, Account Code 663G-35000-4UG0220STDSTD, for the cleanup and remediation of soil impacted due to oil in abandoned pipelines on York Street.

 

                     SECTION 2. That an appropriation in the amount of $120,487 is authorized from the unappropriated grant proceeds of the Water Replacement Fund into Account Code 663G-35000-4UG0220STDSTD for the York Street Project; and further authorizing the expenditure of same.

 

                     SECTION 3.  That the Director of Finance is authorized to issue his warrant or warrants against the account code above in an amount not to exceed $120,487 in payment of the above authorized obligations upon presentation of the proper voucher or vouchers.

 

SECTION 4. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.

 

SECTION 5. That this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this ordinance must be immediately effective in order to accept funding from the U.S. Environmental Protection Agency for the cleanup and remediation of soil impacted by oil found in abandoned pipes.
