Moratorium on Gasoline & Fuel Stations

Driscoll, Sarantou, McPherson

Title

Declaring a Moratorium until November 30, 2026, on the issuance of any zoning permits, building permits, certificates of occupancy, or other licenses or permits for gasoline and fuel sales, in the City of Toledo; requesting a Plan Commission study; and declaring an emergency.

Body

SUMMARY & BACKGROUND

The City of Toledo seeks to promote prosperous development, promote public health, safety, and welfare, and ensure land use regulations reflect the current and future needs of the community. The proliferation of gasoline and fuel sales stations have impacts related to traffic congestion, environmental concerns, land use compatibility, and long-term economic development.

Toledo City Council finds it necessary to request the Toledo Plan Commission study spacing requirements, square footage allowance, 24-hour special use permits, licensing as outlined in Toledo Municipal Code Chapter 721, and Neighborhood Commercial zoning code as it relates to gasoline and fuel sales stations.

A temporary moratorium is necessary to allow time for the study to occur and to prevent the establishment of uses that may be inconsistent with future regulatory changes. This moratorium will apply to new gasoline and fuel stations as well as expansions of existing gasoline and fuel stations that increase fuel dispensing capacity. This moratorium will not apply to routine maintenance or repair of existing facilities that do not expand capacity or project that have received all necessary approvals and permits prior to the effective date of this Ordinance

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

SECTION 1.                     For the reasons stated in the Summary & Background, this Council establishes a moratorium on the issuance of zoning permits, building permits, certificates of occupancy, and other licenses or permits for gasoline and fuel sales in the City of Toledo on applications filed after the effective date of this moratorium. This moratorium shall be in effect until November 30, 2026.

SECTION 2.                     It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.

SECTION 3.                     That this ordinance is hereby declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for this emergency lies in the fact that the same is necessary for the immediate preservations of the public peace, health, safety, and property, and for the reason being that the moratorium will allow the Plan Commission time to study and report to Council its recommendations.
