SUMMARY & BACKGROUND:

The state of Ohio has awarded the Toledo Police Department $100,000 in recognition of the Forensic Laboratory achieving accreditation in 2018. The funds are required to be used for direct expenses related to chemistry laboratory work. The funds will be used to purchase an Agilent Technologies gas chromatograph mass spectrometer (GC/MS). The addition of this GC/MS will enable the Forensic Lab to effectively double their capacity to process drug cases and reduce case backlogs.   

 

This ordinance will authorize the Mayor to accept, deposit, appropriate, and expend $100,000 from the State of Ohio grant proceeds, and authorize the expenditure of $2,452.79 from the General Fund. The total expenditure for the purchase of the Agilent gas chromatograph mass spectrometer is $102,452.79.

 

The forensic lab has been using an Agilent GC/MS for 15 years and all personnel are trained in its use.  In addition every accredited laboratory in the State of Ohio uses Agilent GC/MS instruments. Agilent 5977B GC/MS was specifically designed for Forensic Toxicology and this is the only available mass spectrometer with technologies that provide greater spectral integrity by eliminating surface activity reactions. For these reasons, the competitive bidding requirements of Toledo Municipal Code Chapter 187 are requested to be waived.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1. That the Mayor is authorized to accept and deposit a forensic laboratory grant from the state of Ohio ,Office of the Attorney General in the amount of $100,000 into the Operation Grants Fund Account Code 2016-52000-3G00161STDSTD.

 

SECTION 2.    That the appropriation of $100,000 is authorized from the un appropriated grant proceeds in the Operation Grants Fund to Account Code 2016-52000-3G00161STDSTD; and the expenditure of same is for the purchase of an Agilent Technologies Intuvo 9000/5977B gas chromatograph mass spectrometer.

 

SECTION 3.  That an expenditure of $2,452.79 is authorized from General Fund, Account Code 1001-52000-3381002STDSTD, for the purpose listed in Section 2.

 

SECTION 4.                      That this Council agrees to waive the competitive bidding requirements of Toledo Municipal Code Chapter 187.  The reason for the waiver is due to the fact that Agilent Technologies is the sole source manufacturer of this instrument.

 

SECTION 5.  That the Finance Director is authorized to draw her warrant or warrants against the above mentioned account code in an amount not to exceed $102,452.79 in payment of the obligations authorized above upon presentation of the proper voucher or vouchers.

 

SECTION 6.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that it is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason of increasing capacity to process drug cases.
