Authorizing the Mayor to enter into a contract with Edward Kelly and Sons for emergency repair services to the sanitary sewer at Arlington and Francis; waiving the formal competitive bidding provisions of TMC Chapter 187; and declaring an emergency.

SUMMARY & BACKGROUND:
An existing 48” sanitary sewer, 45 feet below ground, located at Arlington and Francis has collapsed causing a sinkhole in the pavement. Due to the emergency repair needed, the Division of Engineering and Construction Management requested quotes from six contractors. Edward Kelly and Sons provided the best and lowest bid at $829,563 and has been contracted to begin repairs immediately.
Funding for this repair is authorized through Ord. 146-20, Large Diameter Sewer Replacement and Ord. 10-24, Various Sewer Replacements and Improvements. This ordinance will allow the division to waive competitive bidding in order to immediately begin repairs in an effort to preserve the health, safety, and property of the general public.
Summary
NOW, THEREFORE, be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to enter into a contract with Edward Kelly and Sons for emergency repair services to the sanitary sewer at Arlington and Francis, upon such terms and conditions approved by the Director of Transportation and the Director of Law.
SECTION 2. That this council finds and determines that it is in the best interest of the City to waive the formal competitive bidding provision of TMC Chapter 187 for the reason that Edward Kelly and Sons has significant institutional knowledge of the project and was immediately ready to proceed with repairs to mitigate a significant risk to the general public.
SECTION 3. That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety, and property and for the further reason that this Ordinance must be immediately effective in order to pay Edward Kelly and Sons for emergency repair services related to the sewer repair at Arlington and Francis.
