Title

Amending Ord. 103-22 which authorized the appropriation and expenditure of $10,000,000 from the Local Fiscal Recovery Fund for the Full Lead Service Line Replacement Project to expand the scope of the lead service line replacement to include galvanized steel service lines and authorizing the Department of Public Utilities to complete plumbing repairs necessitated by the Advanced Metering Infrastructure (AMI) upgrades; and declaring an emergency.

SUMMARY & BACKGROUND:

This ARPA funded project, originally authorized by Ord. 103-22 anticipated specialized work of approximately 3,000 locations in the City of Toledo Water Distribution service area.  The division estimate was based on the 1,000 listed locations per year.  The city reserved the right to add or subtract from the list at the city’s discretion.  The actual locations and scheduling were to be determined by the Division of Water Distribution.

 

The contractor would be required to replace the existing house line from the curb box to the house, into the house, and tie into the existing service meter.  The contractor shall re-expose the curb box, install new copper house line to the house, and through the building foundation to within 1 foot of the existing service meter, and connect to the existing service meter including all valves, bends, fittings, etc. to properly connect to the existing service meter per AWS Standard Drawings 2017-009-04, 2017-009-05, and 2017-009-28.  The contractor shall schedule for final review of the house line installation prior to backfilling the excavations or restoration inside the house.

                     

The City’s Division of Water Distribution has not identified the amount of lead service line as originally anticipated. Rather there is a significant amount of galvanized steel pipe service lines downstream of lead service lines. The Department of Treasury indicates that under ARPA, replacement of service lines is an eligible use under the Drinking Water State Revolving Fund (DWSRF), and further states this is eligible regardless of the pipe material. Expanding the scope of this ordinance to include galvanized steel service lines is an eligible use of State and Local Fiscal Recovery Funds.

                     

Additionally, the City’s Division of Water Distribution has discovered significant costs related to plumbing repairs of older homes necessary for these infrastructure improvements and related to the AMI upgrades. The Department of Treasury has stated eligible projects under the Clean Water State Revolving Fund (CWSRF) are eligible uses of ARPA funds and includes the “installation, replacement, or upgrade of water meters.” With this amendment, the Division of Water Distribution would use a portion of this ARPA allocation to expand the scope of the service line project to include galvanized steel replacement and to make repairs necessary for the installation and upgrade of AMI meters as permitted under the ARPA guidelines.

 

Upon final approval, the contractor shall then perform all surface restoration for the service line and house line work within the rights-of-way, on private property, and inside the house and may include, but not limited to tree removal, pavement, curb, gutter, sidewalk, retaining wall, driveway apron, and lawn strip restoration, and may including replacing trees.

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.                      That SECTION 1 or Ord. 103-22 which reads as follows:

                     That the appropriation of $10,000,000 is authorized from the unappropriated balance of the Local Fiscal Recovery Fund to Account Code 2021-34000-4LEADLINESWSB and the expenditure of same is authorized for the Full Lead Service Line Replacement Project.

 

is repealed.

 

                      SECTION 2. That a new SECTON 1 of Ord. 103-22 is enacted to read:

                     That the appropriation of $10,000,000 is authorized from the unappropriated balance of the Local Fiscal Recovery Fund to Account Codes 2021-34000-422LEADLNEWSB, 2021-34000-422LEADLNESTL, and 2021-34000-422LEADLNEWTR, and the expenditure of same is authorized for the Full Lead Service Line Replacement Project and for the replacement of galvanized steel service lines downstream from lead lines, and plumbing repairs necessitated by the installation or upgrade of AMI smart meters.

 

SECTION 3.  That except as amended herein all other provisions of Ord. 103-22 reman in full force and effect.

 

                     SECTION 4.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that same is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to ensure the distribution of quality potable drinking water to the residents of the City of Toledo.
