Authorizing the appropriation and operating transfer of $500,000 from the Sewer Operating Fund into the Sewer Replacement Fund; authorizing the appropriation and expenditure in an amount not to exceed $500,000 from the Sewer Replacement Fund for the Renovation of the Chlorination and De-Chlorination Facilities at the Water Reclamation Plant; authorizing the mayor to accept bids and to execute agreements, for professional services necessary to facilitate the design of the Chlorination System Renovations Project; and declaring an emergency.

SUMMARY & BACKGROUND:
The Water Reclamation Plant (Plant) employs chlorination equipment such as evaporators, chlorinators and injectors to inject chlorine solution into the Secondary treated wastewater to control E-coli count in the final effluent. The Plant also employs de-chlorination equipment to inject sodium bisulfite into the chlorinated final effluent to react with and remove chlorine residual from the final effluent to protect aquatic life in the Maumee River and to comply with the Plant’s NPDES discharge permit. The existing equipment and systems are over 25 years of age and are beyond the intended service life. This project will address civil, structural, mechanical and electrical improvements for the complete replacement of the chlorination and de-chlorination equipment and related systems. The Division of Water Reclamation (Division) has advertised for and received proposals for professional engineering services for this purpose. The Division seeks to transfer funds from the Sewer Operating Fund to the Sewer Replacement Fund, and to further appropriate and expend such funds on the Chlorination System Renovations project.

Summary
NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:
SECTION 1. That the mayor is authorized to transfer $500,000 from the Water Reclamation’s Sewer Operating Fund, Account Code 6070-36000-558100-4000507STDSTD to the Sewer Replacement Fund, Account Code 6073-36000-408690-4UC3219STDSTD.
SECTION 2. That an amount not to exceed $500,000 is authorized for appropriation and expenditure from the unappropriated balance in the Sewer Replacement Fund into account code 6073-36000-4UC3219STDSTD to facilitate the design of the Chlorination System Renovations Project at the Water Reclamation Plant.
SECTION 3. That the mayor and the Director of Public Utilities are authorized to advertise for and accept proposals, and to execute agreements, contracts, and purchase orders for professional engineering services necessary to facilitate the design of the Chlorination System Renovations Project at the Water Reclamation Plant, subject to approvals by the Director of Finance and the Director of Law.
SECTION 4. That the Finance Director is authorized to issue his warrant or warrants against the account code identified in Section 2 above, in an amount not to exceed $500,000 for the design of the Chlorination System Renovations Project at the Water Reclamation Plant, and to make necessary expenditures in payments of the obligations incurred pursuant to agreements and contracts authorized in Section 3 above upon presentation of the proper voucher or vouchers.
SECTION 5. That various adjustments and line item expenditures and transfers are authorized to comply with agreements and contracts authorized in Section 3 above.
SECTION 6. That the disappropriation of any remaining budget to fund balance is authorized at project closeout.
SECTION 7. That the ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that this ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this ordinance must be immediately effective in order to maintain the operational integrity of the Water Reclamation Plant, and to maintain compliance with the NPDES discharge permit requirements, as set forth by the Ohio EPA.
