Title

Authorizing the expenditure of $50,000 from the General Fund for emergency tree clearing and removal at Detwiler Golf Course and Cullen Park; authorizing the Mayor to amend the agreement with The Davey Tree Expert Company; and declaring an emergency.

SUMMARY & BACKGROUND:

Ordinance 367-23 authorized the expenditure of $80,000 and waived competitive bidding for this emergency work to clear trees at Detwiler and Cullen Park that were blown down or severely damaged by the June 15, 2023 tornado. This Ordinance authorizes the expenditure of an additional $50,000 to complete this work. 

 

Summary

NOW, THEREFORE, Be it ordained by the Council of the City of Toledo:

 

SECTION 1.  That the expenditure of an amount not to exceed $50,000 is authorized from the General Fund Account Code 1001-40100-7741001STDSTD for emergency tree clearing and removal services at Detwiler Golf Course and Cullen Park.

 

SECTION 2. That the Mayor is authorized to amend the agreement with The Davey Tree Expert Company for emergency tree clearing and removal services, upon such terms and conditions as shall be approved by the Director of Parks and Youth Services and the Director of Law.

 

                     SECTION 3.  That the Finance Director is authorized to draw warrant or warrants against the Account Code in Section 1 in payment of the above-authorized obligations in an amount not to exceed $50,000 upon presentation of the proper voucher or vouchers.

 

SECTION 4.  That this Ordinance, being an emergency measure, shall take effect and be in force from and after its passage. The reason for the emergency lies in the fact that the Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and so that the clearing and removal services can be completed.

 

 

Vote on emergency clause:  yeas 10, nays 0.
