SUMMARY & BACKGROUND:
The City of Toledo has been awarded a 319(h) grant from the Ohio Environmental Protection Agency (OEPA) in the amount of $278,480 to be used for the Delaware Creek Stream Restoration Project, Phase 3. This Ordinance authorizes the Mayor to accept, deposit, appropriate and expend up to $278,480 in grant proceeds from the OEPA.
Summary
NOW THEREFORE Be it ordained by the Council of the City of Toledo:
SECTION 1. That the Mayor is authorized to execute all necessary grant documents with the Ohio Environmental Protection Agency (OEPA) for the Delaware Creek Stream Restoration Project, Phase 3, upon terms and conditions acceptable to the Director of Public Utilities and the Director of Law.
SECTION 2. That the Mayor is authorized to accept and deposit grant proceeds from the OEPA’s 319(h) grant in an amount not to exceed $278,480 into the Operation Grants Fund, Account Code 2016-38000-6G00317STDSTD.
SECTION 3. That the appropriation from the unappropriated grant proceeds in an amount not to exceed $278,480 is authorized from the Operation Grants Fund into Account Code 2016-38000-6G00317STDSTD; and further authorizing the expenditure of same for the Delaware Creek Stream Restoration Project Phase 3.
SECTION 4. That the Mayor is authorized to accept bids and execute necessary contracts to perform work under this grant upon such terms and conditions as shall be approved by the Director of Public Utilities and the Director of Law.
SECTION 5. That the Director of Finance is authorized to issue their warrant or warrants against the Account Code 2016-38000-6G00317STDSTD in an amount not to exceed $278,480 in payment of the above obligations upon presentation of proper voucher or vouchers.
SECTION 6. That this Ordinance is declared to be an emergency and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property of the city and for the further reason that this Ordinance must be immediately effective in order to implement this program within the Environmental Protection Agency’s designated time schedule.
