Summary
SUMMARY & BACKGROUND:
Residents have expressed concerns regarding the use, access, and sharing of information collected through the Flock system under the control or supervision of the City of Toledo.
To provide assurance regarding the City's governance and oversight of this technology, Toledo City Council requests an independent audit of the City's use of the Flock system.
The audit should evaluate whether adequate policies, procedures, and controls have been established and implemented to ensure that the Flock system and associated information are accessed, searched, shared, retained, and used only for authorized and appropriate purposes.
The audit should include consideration of:
• searches performed by City personnel, including available information regarding the users performing searches and the documented purposes for those searches;
• searches of, or access to, the City's Flock network or data by outside agencies or jurisdictions;
• user access and authorization controls;
• network-sharing arrangements and controls governing access by outside agencies or jurisdictions;
• hotlist configuration, administration, and use;
• applicable data-retention requirements and configurations;
• policies, procedures, training, and other requirements governing use of the technology;
• monitoring, audit logging, supervisory review, and other controls designed to identify unauthorized or inappropriate use; and
• compliance with applicable City and departmental policies, contractual requirements, and applicable laws and regulations.
The City Auditor shall determine the appropriate audit period, scope, testing methodology, and procedures based on professional judgment, risk assessment, availability of records, and the work necessary to accomplish the audit objectives.
NOW, THEREFORE, Be It Resolved By The Council Of The City Of Toledo:
SECTION 1. That Toledo City Council requests the City Auditor to conduct an audit of the City's use and oversight of the Flock system to evaluate the adequacy of governance and controls over access, use, retention, monitoring, and sharing of Flock information.
SECTION 2. That City departments and personnel responsible for the administration or use of the Flock system are requested to provide the auditor with access to records, system information, personnel, policies, agreements, configurations, audit logs, and other information reasonably necessary to perform the audit, subject to applicable legal requirements.
SECTION 3. That the auditor shall report the results of the audit to Toledo City Council, including significant findings and recommendations concerning the governance, oversight, authorized use, access, monitoring, and sharing of the Flock system and information.
SECTION 4. That the auditor shall retain professional discretion to determine the audit procedures, sampling methodology, data analysis, evaluation criteria, and other procedures necessary to accomplish the audit objectives.
SECTION 5. That this Resolution is declared to be an emergency measure necessary for the immediate preservation of the public peace, health, safety, and property of the City and for the further reason that this Resolution is required to be immediately effective to permit timely commencement of the audit and communication of its results to Council and the public.
