Body

SUMMARY & BACKGROUND:

The Division of Engineering and Construction Management has been working closely with Lucas County to secure federal grant funding for a safety project. A maximum of $9,892,573 has been allocated by the federal government through the County for the Safe Streets for All program. This funding includes $1,072,573 that is made available for preliminary design. Matching funds of 20% will be provided through the Division of Engineering and Construction Management Matches and Planning budget and through the West Toledo Tax Increment Financing (TIF). This project is preliminarily planned for construction in 2028 and 2029.

 

Passage of this ordinance is required to enable the City of Toledo to accept outside funding for these projects and have it in place to help pay for these expenditures.

 

Summary

NOW THEREFORE Be it ordained by the Council of the City of Toledo:

 

                     SECTION 1. That the Mayor is authorized to enter into and execute cooperative agreements with and accept financial assistance from Lucas County for the Safe Streets for All project upon such terms and conditions shall be approved by the Director of Transportation and the Director of Law.

 

SECTION 2.                     That the Mayor is authorized to accept and deposit grant proceeds from Lucas County into the Capital Improvement Fund in an amount not to exceed $9,892,573 for the following project:

SECTION 3.  That the appropriation of $9,892,573 is authorized from the grant proceeds of the Capital Improvement Fund into the Account Code listed in Section 2 for the project listed above; and authorizing expenditure of same.

 

SECTION 4.   That the Mayor is authorized to prepare plans and specifications and to enter into contracts for said project including such items as labor, materials, construction testing, professional services, property appraisals, title work, negotiations, acquisition, and environmental contamination studies that are necessary to acquire additional rights-of-way. Contract shall contain such terms and conditions as the Mayor may deem requisite and proper and shall be subject to approval by the Director of Transportation and the Director of Law.

 

SECTION 5.  That the Finance Director is authorized to issue their warrant or warrants against the Account Code identified in Section 2 in an amount not to exceed $9,892,573 in payment of the obligations incurred pursuant to the contracts authorized in Section 4 upon presentation of the proper voucher or vouchers.

 

                     SECTION 6.  That this Ordinance is declared to be an emergency measure and shall be in force and effect from and after its passage.  The reason for the emergency lies in the fact that this Ordinance is necessary for the immediate preservation of the public peace, health, safety and property, and for the further reason that this Ordinance must be immediately effective in order to facilitate the planning and construction of the project.
